MARION COUNTY — Due to allegations a 22-year-old Chicago man made about his counsel in his pre-sentencing report, a judge ordered a hearing on the matter Tuesday during what had been scheduled for sentencing of Darius Holliday.

Judge Allen Lolie ordered a Krankel hearing conducted Tuesday, and found that Holliday’s public defender was not ineffective for failing to call Juan Hayes to testify during the two-day trial in Marion County Court last month, or for failing to file a motion for change of venue.

Hayes was one of two victims Holliday shot over the summer at Laura Leake Park in Centralia. The other victim, Devale Johnson Jr., was called as a witness by the prosecution.

After deliberating for less than 2-hours last month, a Marion County jury found Holliday guilty of two counts Class X felony aggravated battery by discharging a firearm.

Following Tuesday’s Krankle hearing, Judge Lolie ordered Holliday’s public defender to remain as counsel for the defendant, and rescheduled sentencing for 1 p.m. December 20. The hearing is expected to take approximately one hour.
