FAYETTE COUNTY — A 24-year-old Chicago man charged with escaping from the Vandalia Correctional Center 2014, will have his case tried by a judge.

Marcus Battice appeared in court Tuesday and agreed to waive his rights to a jury trial and instead have his case decided by a judge. The bench trial was scheduled for February 27, in Fayette County court.

The case has been delayed while a psychological evaluation of Battice was conducted. The results of that evaluation have now been filed with the court.

Battice is charged with Class 2 felony escape, from a penal institution. He has been released from the Illinois Department of Corrections as he completed the sentence he was serving time for when he allegedly escaped.

He is now being held in the Fayette County jail where he has remained since his release from IDOC.
