FAYETTE COUNTY — A Fayette County jury spent less than an hour Wednesday to return a verdict of guilty on all charges against a 56-year-old Vandalia man charged with three counts possession of child pornography.

William Frakes was facing two Class X felonies for possession of child pornography depicting a child under the age of 13 in a sadistic manner and Class 2 felony possession of child pornography of a child under the age of 13.
The prosecution delivered its case Tuesday and recalled witnesses on Wednesday. The defense rested its case Wednesday and closing arguments were presented.
State’s Attorney Josh Morrison arguing that the state had met its burden of proof and asked for the jury to return a guilty verdict.
During the defense’s closing statements, defense attorney argued that Frakes did not have knowledge that the pictures were on the Samsung phone taken by Vandalia Police.
However, the state argued that to have the pictures on the phone and uploaded to a Flickr account associated to two emails of Frakes was not an accident and took affirmative action by Frakes to do both.
Frakes has remained in the Fayette County jail since his July 2016 arrest.
