SALINE COUNTY — The sentencing of a Saline County physician accused of trying to have the state’s attorney kidnapped has been delayed.

Brian Drew, the lawyer representing Brian Burns, is no longer representing his client after filing a motion earlier this month to withdraw representing Burns. The motion said there was a breakdown in communication between Drew and Burns.

The judge gave Burns one month to find a new lawyer. Burns told the judge he was in the process of trying to get Duane Verity of Marion to represent him.

A Saline County jury in May returned a guilty verdict against Burns on the kidnapping charges. He was found guilty of one count each of attempted aggravated kidnapping, solicitation and conspiracy to commit aggravated kidnapping.

Burns allegedly asked a cell mate to help in planning to kidnap the late Mike Henshaw, who was state’s attorney at the time.

Sentencing for Burns is now set for Aug. 29 at 2 p.m. in Saline County Court.

Burns is still in jail awaiting a Jan. 18 jury trial for allegedly killing his wife Carla Burns last year. He faces two murder charges and a charge of concealment in that case.
